Boasberg having temporarily halted the deportations to having taken place on the same day.<\/p>\n<p class=\"text_text__nEn66\">However, White House secretary Karoline Leavitt refuted claims that the\u00a0Trump\u00a0administration defied a court order, issuing a statement to say that the president and his team \u2018did not refuse to comply with a court order\u2019.<\/p>\n<p class=\"text_text__nEn66\">CBS\u2019\u00a0<em>60 Minutes<\/em>\u00a0carried out an investigation into the 238 Venezuelans who have been branded criminals by the US government \u2013 with 179 of those holding no public criminal record.What is the Alien Enemies Act of 1798?<\/p>\n<p class=\"text_text__nEn66\">The Alien Enemies Act of 1798, a relatively unknown 18th century law, was\u00a0created in response to spying and sabotage during tensions with France at the time, and was passed shortly after the US was liberated from the British Empire.<\/p>\n<div id=\"mantis-ui-widget-container\" class=\"mantis-recommender default\"><main>&nbsp;<\/p>\n<div id=\"wrapper\" class=\"wrapper\">\n<div id=\"main\" class=\"container slide-in-effect\">\n<div class=\"slide\" invasion or predatory incursion\u2019 against the US government from a foreign government.<\/p>\n<p class=\"text_text__nEn66\">Until the president terminates it, it can remain in action for as long as necessary.<\/p>\n<p class=\"text_text__nEn66\">It has already been used a handful of times in the US throughout\u00a0history\u00a0\u2013 the last being to justify internment camps for\u00a0Japanese, German and Italian citizens, who were the Axis powers at the time, during the Second World War.<\/p>\n<h2>Why Trump wanted to impose the 18th-century wartime law<\/h2>\n<p class=\"text_text__nEn66\">Immigration has been a hot topic for the US president, as\u00a0Donald Trump\u00a0touted his hard-line approach during his campaign trail and signed an executive\u00a0order\u00a0to \u2018protect the American people against invasion\u2019 within hours of taking over the\u00a0White House\u00a0on January 20.<\/p>\n<p class=\"text_text__nEn66\">The Alien Enemies Act of 1798 would allow Trump to quickly deport migrants accused of \u2018invasion or predatory incursion and those deemed to be gang members\u2019,\u00a0reports\u00a0Reuters.<\/p>\n<div designating\u00a0criminal\u00a0cartels, like the Venezuelan gang Tren de Aragua, as terrorist organizations where the law would kick-in to allow legal deportations.<\/p>\n<h2>What the block means for mass deportations<\/h2>\n<p class=\"text_text__nEn66\">The block was upheld in the Supreme Court by a vote of seven in favour and two against. However, the process is not over.<\/p>\n<p class=\"text_text__nEn66\">The justices have now sent the case back to a federal appeals court where they must decide on the underlying issue that has arisen from the US government\u2019s use of the Alien Enemies Act of 1798.<\/p>\n<p class=\"text_text__nEn66\">\u201cUnder these circumstances, notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster,\u201d the unsigned ruling read in part.<\/p>\n<p class=\"text_text__nEn66\">It means the men being held in a detention north\u00a0Texas\u00a0will be given a chance to prove their innocence before being exiled to the CECOT.<\/p>\n<h2>How Trump has responded<\/h2>\n<div and even those who are mentally insane, who came into our Country illegally, are not allowed to be forced out without going through a long, protracted, and expensive Legal Process.<\/p>\n<p class=\"text_text__nEn66\">\u201cOne that will take, possibly, many years for each person, and one that will allow these people to commit many crimes before they even see the inside of a Courthouse.
