The people who were responsible for reading the radiographs misread it.\u201d<\/strong><\/p>\n<div class=\"code-block code-block-9\"><\/div>\n<p><strong>\u201cThe ER doctor saw this patient was having all these signs and symptoms of stroke and never called a stroke alert, and they had policies in place that they were supposed to follow certain protocols to reach the correct diagnosis, and they didn\u2019t follow their policies and procedures.\u201d<\/strong><\/p>\n<p>The chiropractor, the hospital, Dr. Matthew Womack, radiologist James Waldschmidt, and the on-call neurologist Christopher Nickum were all sued by Jonathan\u2019s family.<\/p>\n<div class=\"code-block code-block-11\"><\/div>\n<p>A jury in a state court in Fulton County found Womack and Waldschmidt \u2018grossly negligent\u2019 in failing to identify Jonathan\u2019s disease, and as a result, he was given a $75 million award.<\/p>\n<p>Womack failed to inform Nickum that Jonathan had seen a chiropractor that day and that the patient had gone through two seizure-like episodes, the court also heard.<\/p>\n<div class=\"code-block code-block-13\"><\/div>\n<p>ANF claims that the radiologist also failed to notice important scan information, but the chiropractor, the hospital, and its employees were not held accountable.<\/p>\n<p><strong>\u201cThis case is heartbreaking because Jonathan\u2019s paralysis and brain damage were completely avoidable,\u201d<\/strong>\u00a0Bell said following the verdict.<\/p>\n<p><strong>\u201cIf the slew of healthcare providers involved in Jonathan\u2019s care would have acted according to the standard of care, caught and treated his stroke earlier, and communicated more effectively, Jonathan\u2019s life would look entirely different.\u201d<\/strong><\/p>\n<div class=\"code-block code-block-15\"><\/div>\n<p>Jonathan received enormous compensation, but according to his family, it still doesn\u2019t make up for the life he lost.<\/p>\n<p><strong>\u201cI really feel like there\u2019s no real justice for somebody who lost every aspect of his life,\u201d<\/strong>\u00a0his father, Jack Buckelew, said.<\/p>\n<div class=\"code-block code-block-18\"><\/div>\n<p><strong>\u201cWe\u2019re just focusing on what can we do now; how can we keep him as happy as possible; and how can we give him the best life possible.\u201d<\/strong><\/p>\n<p>The father added that, along with a group of nurses, he and Jonathan\u2019s mother, Janice, now provide round-the-clock care for their once lively and fit son.<\/p>\n<div class=\"code-block code-block-19\"><\/div>\n<p>Their garage has been converted into a medical supply room, and they have modified their house to accommodate Jonathan, who is mute and only communicates by blinking or typing on a keypad with his nose.<\/p>\n<p><strong>\u201cWe do work really hard to keep at least two months ahead on the supplies,\u201d<\/strong>\u00a0Jack said.\u00a0<strong>\u201cWe created an ICU, honestly.\u201d<\/strong><\/p>\n<div class=\"code-block code-block-20\"><\/div>\n<p>He then said of his son,\u00a0<strong>\u201cIn spite of his spirit which keeps us going \u2013 because he wants to do things, he wants to go places \u2013 it just breaks our heart to see him like he is.\u201d<\/strong><\/p>\n<p><strong>\u201cThere are some days where he\u2019s like \u2018pull the plug,\u2019 so those are the tough days.\u201d<\/strong><\/p>\n<div class=\"code-block code-block-21\"><\/div>\n<p>Womack first had the court decision rejected when he appealed it.
