A trial date has not yet been set.<\/p>\n<p>As the ruling was read aloud, Gilbert \u2014 Busfield\u2019s wife of more than a decade \u2014 became visibly emotional in the courtroom.<\/p>\n<div id=\"newsner-1493043998\" class=\"newsner-article_inside_content\"><\/div>\n<div id=\"newsner-d2923d36122f85124474d0187158515e\" class=\"newsner-d2923d36122f85124474d0187158515e newsner-amp_article_inside_content\"><\/div>\n<h2 id=\"h-prosecutors-raise-concerns\" class=\"wp-block-heading\">Prosecutors raise concerns<\/h2>\n<p>Busfield\u2019s release ahead of trial was far from guaranteed.<\/p>\n<p>New Mexico prosecutors argued against it, claiming the actor and director has a history of inappropriate behavior and questioning his willingness to comply with court orders.<\/p>\n<p>For example, they cited an allegation from actress Claudia Christian, who claimed Busfield \u201cforcibly grabbed her and threw her against the wall\u201d while the two were working together on\u00a0<em>The Strays<\/em>. Christian reportedly told an assistant director about the incident at the time.<\/p>\n<p>The state also pointed to Busfield\u2019s actions following the issuance of an arrest warrant, arguing that he delayed surrendering to authorities.<\/p>\n<p>\u201cThe state is concerned about again the defendant is using his control in deciding when he wants to comply with an order,\u201d prosecutors told the court. \u201cThat order did not say, \u2018Sure, turn yourself in in 5 days.\u2019 That order was for him to be arrested and come deal with these charges. Instead, he drove 2,000 miles \u2026 he got a polygraph.\u201d<\/p>\n<p>\u201cI\u2019m not saying defendants don\u2019t have a right to defend their case,\u201d the prosecutor added, \u201cbut that shows this court that the defendant is only going to comply when he wants to, when he\u2019s ready to.\u201d<\/p>\n<p>Despite those concerns, the judge ruled that Busfield could be released under supervision.<\/p>\n<h2 id=\"h-psychosexual-evaluation-and-gilbert-s-role\" class=\"wp-block-heading\">Psychosexual evaluation and Gilbert\u2019s Role<\/h2>\n<p>Days before being remanded into custody, Busfield underwent a psychosexual evaluation at the request of his legal team. (Photo by Sam Wasson\/Getty Images)<\/figcaption><\/figure>\n<p>The report also noted Busfield\u2019s views on maturity and intimacy.<\/p>\n<p>\u201cMr. Busfield reports that as he reflects, he believes and values that an individual needs to have a certain level of maturity to understand and embrace the intimate nature of a sexual relationship,\u201d the evaluation continued. \u201cAdditionally, he also believes sex is a natural experience for all humans and that at a certain age you begin to start experiencing feelings in your body (puberty).\u201d<\/p>\n<p>Busfield reportedly told evaluators that meeting Gilbert changed his life.<\/p>\n<p>\u201cHe has come to realize that he never had the mate he wanted until he met his wife, Melissa.\u201d<\/p>\n<p>Following the assessment, Busfield was categorized as \u201cvery low risk,\u201d with evaluators citing his willingness to answer difficult questions, steady employment, strong family support, and engagement in prosocial activities.<\/p>\n<h2 id=\"h-legal-expert-weighs-in\" class=\"wp-block-heading\">Legal expert weighs in<\/h2>\n<p>According to legan expert Donna Rotunno, the evaluation was likely intended to influence the judge\u2019s decision.<\/p>\n<div id=\"newsner-476934469\" class=\"newsner-article_inside_content\"><\/div>\n<div id=\"newsner-999fce14c4ba5078a898874d7eeb15c4\" class=\"newsner-999fce14c4ba5078a898874d7eeb15c4 newsner-amp_article_inside_content\"><\/div>\n<p>\u201cWhen you submit to those evaluations, you have to answer truthfully,\u201d Rotunno told Fox News. \u201cHe is hoping that the evaluation will help the judge decide he is not a threat to society.\u201d<\/p>\n<p>She added that involving Gilbert in the process was standard.<\/p>\n<p>\u201cAs uncomfortable as the subject matter is, it is common that they would interview the wife under the circumstances for corroboration, and to see how forthcoming and truthful he is being.\u201d<\/p>\n<h2 id=\"h-gilbert-s-emotional-letter\" class=\"wp-block-heading\">Gilbert\u2019s emotional letter<\/h2>\n<p>Among more than 75 letters submitted to the court were several written by Gilbert herself, passionately defending her husband\u2019s character.<\/p>\n<p>\u201cThe reality is that Tim Busfield is my love, my rock, my partner in business and life,\u201d she wrote. \u201cHe is my comfort and my council. His joy, humor and quick wit bring sparkle to my life. Tim is, quite simply, the beating heart of our wild and wonderful extended family.\u201d<\/p>\n<p>Gilbert told the court she knows Busfield \u201cbetter and more intimately than anyone else in his life,\u201d describing him as a man guided by compassion and principle.<\/p>\n<p>\u201cTim has the strongest moral compass of any human I have ever known,\u201d she wrote. \u201cHe has dedicated his spiritual self to always being of service to others. He starts every day with kindness and compassion.\u201d<\/p>\n<p>In one of the most emotional passages, Gilbert pleaded directly with the judge.<\/p>\n<div id=\"newsner-602684486\" class=\"newsner-article_inside_content\"><\/div>\n<div id=\"newsner-aea2ea6265d9ca41ef2252ef5dd32c2c\" class=\"newsner-aea2ea6265d9ca41ef2252ef5dd32c2c newsner-amp_article_inside_content\"><\/div>\n<p>\u201cThis is the strangest letter I\u2019ve ever had to write,\u201d she said. \u201cSo, I will close by asking you to please, please, take care of my sweet husband. As he is my protector, I am his, but I cannot protect him now and I think that, more than anything else, is what is truly breaking my heart.\u201d<\/p>\n<p>Others who spoke up for Busfield through written letters included his stepson, Michael, as well as his former\u00a0<em>Thirtysomething<\/em>\u00a0co-stars Ken Olin and Peter Horton.<\/p>\n<h2 id=\"h-what-comes-next\" class=\"wp-block-heading\">What comes next<\/h2>\n<p>The charges against Busfield are tied to allegations that he inappropriately touched two 11-year-old twins while working on the set of\u00a0<em>The Cleaning Lady<\/em>, according to a criminal complaint obtained by ABC News.<\/p>\n<p>One child claimed the alleged incident occurred in a bedroom on set. Saturday I got in the car, drove 2,000 miles to Albuquerque. I\u2019m gonna confront these lies. They\u2019re horrible,\u201d he said. \u201dThey\u2019re all lies and I did not do anything to those little boys and I\u2019m gonna fight it. I\u2019m gonna fight it with a great team, and I\u2019m gonna be exonerated, I know I am, because this is all so wrong and all lies.\u201d<\/p>\n<p>He is currently charged with two counts of criminal sexual contact of a minor under 13 and one count of child abuse.
